The use of this site is governed by the TERMS AND CONDITIONS AGREEMENT OF SALE set forth below.
Your use of this site or purchase from PeteNPlanes indicates your acceptance of these terms and conditions.
PeteNPlanes reserves the right to make changes to this web site and these terms and conditions at any time without any prior notice.
PeteNPlanes is the service provider; it is also referred to as "Pete-N-Planes", "Anthony's Pete-N-Planes", "petenplanes", "PeteNPlanes", "us" and "we".
Customer is the person or organisation who purchases or seeks services from PeteNPlanes ; it is also referred to as "you".
By placing an order to purchase goods with PeteNPlanes you are entering into a legally binding contract to purchase said goods.
PAYMENT
Paypal.
- Due to excessively high PayPal charges of 2.6% of the total transaction cost that Paypal imposes we will have to pass this cost onto the end customer as part of the total price, we can not afford to absorb this cost any longer.
- Similarly Paypal has changed their end user agreements (EULA) to be such that they will no longer reimburse the Paypal transaction fee of 2.6% when a paypal refund goes through for whatever reason. What this means for you the end customer is that if you choose to pay by PayPal, and for any reason whatsoever the sale can not be completed or is canncelled, then you the customer will not be reimbursed for that 2.6% Paypal fee of the total transaction amount. The refund amount you will receieve back will be less the Paypal fee which they (PayPal) retain.
- We are sorry for the inconvenience caused but can not abosrb these grossly over the top Paypal fees and conditions any longer.
- Simple solution is for customers to use our NAB Credit Card Portal or do direct bank transfer EFT.
Credit Card Payments for Overseas and Australian buyers:
Note as of 31 October 2012 we will no longer accept credit card payments from overseas (non resident in Australia) buyers due to a issues we have had with such buyers.
Overseas buyers may now only pay via Paypal if they accept the Paypal fees& condtions of the PayPal EULA regarding refunds. Any payments received via credit cards will be refunded and the order placed into a pending status. We will then send you a payment request via PayPal. Thank you for your understanding in this matter.
For any Australian buyers initiating unwarranted charge backs we do treat this very seriously and will take the necessary legal action to recover funds including any legal costs.
For on-line orders, accepted payments include credit cards (Visa/ Master card ONLY), Direct Deposit and Cheque/Money Order.

The title of the goods supplied does not pass to the customer from PeteNPlanes until the full amount is paid and received.

We will process orders as fast as reasonably possible. PeteNPlanes sends most products Via Australia Post. Methods are chosen in checkout by the customer. We offer Express, Registered or Regular postage. Please note that we will not be responsible for goods lost, delayed or damaged during shipping. Please contact us if you require registered post as the shopping cart uses express or regular by default. Couriers are used for larger items such as kits. Items sent via regular post have no tracking nor insurance and are sent at customer risk. PeteNPlanes accepts no liability nor responsibility for orders whereby the customer elects to use regular post as the shipping method.
Overseas orders will only be sent via Registered, signed for airmail. This protects you and us.
We will only ship goods once payment in full has been received and cleared into our account. We will normally ship goods as soon as reasonaby possible after payment has been received. Goods normally take up to 5 - 10 business days to arrive at your address within
We will endeavour to freight at the lowest possible prices to your area, or we can quote a rate prior to dispatch. Large items such as kits will require to be sent by a courier service. We will strive to arrange for the lowest possible cost in this case.
Postage costs are calculated at Australia Post rates based upon weight and cubic dimesions. This is a much fairer system to you the customer then other online shops offering postage based upon item value. At all times PeteNPlanes will stive to keep costs as low as reasonably possible. After all we are modellers too so we know that every bit helps.
In order to reduce costs and allow us to provide the lowest possible prices, we do not always hold stock of some of the items listed on the web site. Sometimes we may have a particular product shipped direct to you from our suppliers or there may be a delay if the supplier does not have said product in stock. We will inform you ASAP by email or phone to what action you wish to take.
We do not ship to third party addresses unless that address is known and can be verified by PePeteNPlanes .
Customers are responsible for paying any freight charges incurred by refused shipment and unclaimed goods. PeteNPlanes will make every effort to deliver on time.
Customers are responsible to have someone at the delivery address to sign for and accept the delivery. Cost for re-delivery attempts may be passed to the customers if the delivery address is unattended at the time of delivery.
RETURNS
Returns will only be accepted within 7 days of you receiving the goods. Returned goods must be in its original condition and include all the original undamaged packaging. Shipping and handling cost are not refundable. Returns must be notifed and agreed to by PeteNPlanes within 2 days of you recieving the goods. Please note we do not accept returns because you changed your mind.
Any incorrect, missing or damaged items received must be reported to PeteNPlanes within 24 hours of you receiving the delivery.
If item(s) received are not what was ordered please do not open the sealed package in which it was sent. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter.
PeteNPlanes owns the title of any extra goods shipped with your order that have been despatched in error.
WARRANTY CLAIM
All goods sold by PeteNPlanes come with a warranty to be free from any defects or faults. This warranty is not transferable.
Goods under warranty cover will be replaced or repaired by the manufacturer and will be under the terms and condtions of said manufacturer.
Warranty only covers the item(s) sold by PeteNPlanes.
A large percentage of returned goods are found to be, not faulty. If the returned goods are determined by us to not be faulty, then all returning shipping fees will be worn by the customer. We will seek the permission from the customer to charge this cost to the customer's credit card where possible. Failing this, the goods will be sent back by Australia Post COD freight collected. PeteNPlanes also reserves the right to charge the labour cost for examining these goods where no fault was found.
All warranties are voided if returned product is found in any way to be mishandled, misinstalled, modified, tampered, abused, or physically damaged. This includes crash damage!
Please attach a copy of the original invoice or provide the original invoice number. A detailed fault description sheet must be sent together with all the returning warranty goods.
Customer is responsible for any shipping and insurance cost involved in sending the warranty claim goods back to PeteNplanes.
PeteNPlanes is not responsible for any parcel missing in transit, or on its return back to PeteNPlanes. Please use registered or Express Post to protect your item from such losses. Customers who do not use Registered or Express Post or take out insurance cover assume liability for safe and timely delivery of item(s).
DISCLAIMER
Due to changing market forces and other extenuating circumstances that affect product availability, and price stability we reserve the right to withdraw any product we advertise and change prices without notice. This also applies to Postage and shipping costs.
